What is the legal rental status of a rental if a person was?
What is the legal rental status of a rental if a person was introduced to the property via Airbnb and stayed there for a week paying via Airbnb but now pays cash monthly outside Airbnb? There is no written agreement. Does the tenant have any rights? As with all legal questions, the answer depends on where this is happening. In the US, once the tenant remained after his AirBnb contract ended AND occupied the premises for more than 30 days with the owner's knowledge and consent, he became a month-to-month tenant. No written lease is required. The person now has full tenants' rights. But, being month-to-month also means it's a new tenancy each month. The landlord can raise the rent every month, give 30 days notice that the tenancy is terminated, and so on. The tenant can be evicted for non-payment, just like a tenant with a lease, under the same conditions and procedures as any other tenant.
